The agreement between you and LarkGallery when you submit work or buy through this site.

1.Who we are
LarkGallery is an international gallery based in Los Angeles, California, United States, exhibiting and representing contemporary artists, musicians and poets. You can reach us at submissions@larkgallery.com. By using this site you accept these terms.
2.Who can submit
Our open calls are open to artists of all ages and nationalities. If you are under 18, a parent or guardian must agree to these terms on your behalf. Submissions for music and poetry are open to those over 16.
3.Your work must be yours
When you submit, you confirm that you made the work, that you own the rights in it, and that showing it here infringes nobody else’s rights. If the work includes a recognizable person, you confirm you have their permission.
Work that is not yours, that you do not have the rights to, or that is unlawful, will be removed without a refund.
4.You keep your copyright
The copyright in your work stays yours. We do not claim any ownership of it, and we never will.
What you give us is permission to show it: a non-exclusive, worldwide, royalty-free license to display, reproduce and promote your submitted work and your artist details on this site, in our exhibitions and catalogs, and in publicity for them. Nothing more. We do not sub-license your work, sell it to third parties, alter it beyond resizing for display, or use it to train machine-learning systems.
The license lasts while your work is published here. Ask us to take it down and we will, though we may keep material in exhibition archives and printed catalogs that have already been published.
5.Fees and selection
Submission fees are listed on each open call before you pay. They buy consideration by our jurors, not acceptance. Selection is at the gallery’s discretion, and we do not enter into correspondence about individual decisions.
Our refund policy sets out when fees are returned.
6.Payment
Payments are handled by a third-party payment provider on their own secure pages. We never see or store your card details. All prices are in US dollars. Your bank may add a currency conversion or international fee, which is between you and them.
7.Sales of artwork
Where a work is offered for sale, the sale is between you and the gallery on the terms shown at the time. Works are original and often one of a kind, so availability can change. If we cannot supply a work you have paid for, we refund you in full.
8.What we do not promise
We work to keep this site accurate and available, but we do not guarantee it will be uninterrupted or error-free. We are not liable for indirect or consequential losses. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.
Where we are liable, our liability is limited to the amount you paid us in the twelve months before the claim.
9.Changes
We may update these terms. The date at the top of this page tells you when they last changed. The terms that apply to your submission are the ones published when you paid.
10.Law
These terms are governed by the laws of the State of California, and the courts of California have jurisdiction over any dispute. If you are a consumer in the EU or UK, this does not remove the protections of your own country’s law.
